Senior Legal Counsel, Commercial

We are seeking an experienced pharmaceutical legal attorney to provide legal support, counseling, and strategic guidance on the Company’s growing operations in Greater China and other regions. The attorney’s primary focus will be providing legal support, advice and training to Greater China Commercial team. Responsibilities : Be the lead counsel and as an important business partner to provide legal support to the commercialization activities and business development in Greater China market through innovative way of thinking, thoughtful risk taking to integrate legal considerations into functional initiatives. Be a managerial role with 1-2 direct report(s) and make essential efforts in people management and team development, including creating opportunities for individual development, providing day-to-day guidance and support to improve team member’s technical and soft skills. Be a pioneer to drive the team’s daily work excellence and streamline the work process, establish a routine mechanism to facilitate legal counsel’s transparent discussion and experience sharing. Ensure the team is equipped with in-depth knowledge and advanced tools to provide sufficient support to the business team. Conduct legal research and provide legal advice, analysis, training, and guidance on applicable laws and regulations, regulatory, compliance matters with the mindset of thoughtful risk taking to proactively involved in business initiatives and planning to empower business partners. Draft, review a wide variety of contracts, promotional or non-promotional materials, business initiatives and funding projects from legal perspective, and provide feasible risk mitigation solution; be deeply and proactively involved in business negotiation, dispute settlement by providing strategic thoughts. Collaborate with Compliance (BP, Monitoring & Investigation), Internal Control, Internal Audit and other risk control functions in the development and implementation of policies and procedures, SOPs related to compliance, internal control and governance. Lead in the handling external inquiry and investigation from government authorities or complaints arising from potential product liability/patient safety issue. Supervisory Responsibilities: This position will have managerial responsibility. Be a managerial role with 1-2 direct report and make essential efforts in people management and team development, including creating opportunities for individual development, providing day-to-day guidance. Computer Skills: Proficiency in the Microsoft suite of tools including Outlook, Word, PowerPoint and Excel Other Qualifications and Experience: • Admitted to practice law (PRC). At least 10 + years combined relevant experience in an in-house legal department of a pharmaceutical or biotech company, ideally preceded by large, international or national law firm experience. At least 5+ years of extensive experience in legal, compliance and regulatory matters relating to the approval and commercialization of pharmaceutical products, with experience in oncology drug commercialization is strongly preferred. Fluent written and oral skills in Mandarin and English. Comprehensive knowledge of PRC laws applicable to pharmaceutical commercialization, as well as enforcement trends. Exceptional and demonstrated written and verbal communication skills and interpersonal skills in both one-on-one and group settings, as well as proven negotiation skills. Ability to provide clear, concise and solutions-oriented legal advice that is consistent with the Company’s policies and standards. Excellent organizational skills and problem-solving capabilities and the ability to perform in a fast-paced, high volume, deadline-driven environment. Confidence to advise clients at all levels with limited or moderate oversight. Ability to be self-sufficient, while having appropriate judgment to liaise with Legal and Compliance colleagues and/or outside counsel as needed. Commitment to being a team player with the desire to be helpful in all areas covered by a relatively small legal sub-team.
